How do you keep a cidb registration valid?
A cidb registration is needed for public sector construction works awarded by tender or quotation. The contractor applies to renew it 3 months before it expires, tells the cidb of a changed particular within 30 days, pays the annual fee and confirms its particulars on each anniversary, and keeps its tax clearance current.
The registration, and what keeps it valid
The registration itself, then the dates that keep it: renewal 3 months before expiry, a changed particular within 30 days, the annual fee and confirmation on each anniversary, and a new tax clearance certificate within 3 months after the last one expires.

What the library notes on each duty
Quoted a whole sentence at a time from the library's note on each row.
Do not undertake, carry out or complete public sector construction works awarded by competitive tender or quotation unless registered with the cidb and holding a valid registration
s 18(1), (2) · none set · an offence
- A contractor who carries out or attempts public sector construction works unregistered commits an offence, with a fine of up to ten per cent of the value of the contract carried out (s 18(2)), and must stop public sector work on the Board's written notice (s 18(3)), though the Board may let it complete a current contract (s 18(4)).
- Under the Regulations, the registration particulars on the cidb's website serve as the registration certificate (regs 7(11), 7A(10)), and a public sector tender is evaluated only from a contractor registered in the grade and class it names or higher (reg 25(1)).
- Exempt from registration: a homebuilder registered under the Housing Consumer Protection Measures Act 95 of 1998 for a home, and a contract substantially for labour or for supplies (reg 4).
Apply to the cidb to renew a registration three months before it expires, or on the sale or transfer of the business, and pay the renewal fee
s 20(1), (2) · 3 months · the claim is barred
- Registration is valid for three years (s 20(1)); the application is due three months before expiry.
- The Board need not renew a registration because it is current (s 20(3)).
Tell the cidb in writing of any substantive change to the registered particulars within 30 days after the change
s 17(1) · 30 days · a breach of contract
- Regulation 36(1) restates the duty without a day count, and reg 30(1)(d) makes any failure to comply with the Regulations an offence with a fine of up to ZAR 100,000.
- A contractor may also apply to amend its category status (s 17(2)).
Pay the cidb's annual fee for the highest grade held on the date of registration and on each of the next two anniversaries of registration
reg 35(2) · none set · the claim is barred
- Grades 2 to 9 only; grade 1 pays no annual fee (Schedule 2, Table 2).
- A contractor more than 90 days in arrears after being notified is suspended until it pays or makes an arrangement the Board accepts (reg 27(1)), and is removed from the register if it has not put that right one year after suspension (reg 27(3)).
Confirm the registered particulars to the cidb on the approved form on each anniversary of registration
reg 36(2) · none set · the claim is barred
- Due on the date reg 35(2) sets for the annual fee, so for grades 2 to 9; the cidb's register page says annual updates do not apply to grade 1.
Give the cidb a current tax clearance certificate within three months after the previous one expires
reg 36(3) · 3 months · an offence
- Inserted by GN R1224 of 14 November 2008.
- Regulation 30(1)(d) makes a failure to comply with the Regulations an offence with a fine of up to ZAR 100,000; reg 27(2)'s suspension names a certificate missing from the application under reg 7, not this one, so suspension is not recorded as its consequence.
Once registered
A public sector tender names the grade and class of works it needs.
What this page is, and is not
It is the section text this library holds for South Africa's Construction Industry Development Board Act, 2000 (Act 38 of 2000), Construction Industry Development Regulations, 2004, Construction Regulations, 2014, General Administrative Regulations, 2003 and Occupational Health and Safety Act, 1993 (Act 85 of 1993), with the window and the consequence. It is not legal advice, and it is not a substitute for reading the Acts, the Regulations and the contract you signed.
Demiton does not yet track South African projects. These pages set out the duties; the product does not run these checks on a South African job today.
No library of law is complete, and Demiton never says this one is. An obligation the library does not hold, and you did not add, is not protected. You can add your own to any job.
