What cidb grade does a public sector tender need?

Under the cidb Regulations, a public sector tender or expression of interest is evaluated only from a contractor registered in the grade and class of works it names, or higher, or capable of being registered before evaluation. The grade comes from the tender's estimated value and the cidb's grade table, which this library does not hold.

The rule

To have a public sector tender or expression of interest evaluated, be registered in the grade and class of works it names or higher, or be capable of being registered before evaluation (reg 25(1), (1A), (3)). The grade a tender needs comes from its estimated value and the grade table (regs 17 and 25(3)), reference data this library does not hold.

This library does not hold the grade and value table. It is reference data the cidb publishes, so this page gives no grade values or value limits. Read the cidb's current table for those.

What the library notes on the rule

reg 25(1), (1A), (3) · none set · the claim is barred

  • An expression of interest from a contractor not yet registered may be evaluated only if it can be registered within 21 working days after the closing date; a tender, only if it can be registered before evaluation; under extreme conditions the client may accept only contractors already registered (reg 25(2)).
  • That day count binds expressions of interest alone, so no window is recorded.
  • A joint venture qualifies only if every member is registered and the lead partner is no more than one grade below the grade required (reg 25(5)).
  • Before award the employer must be satisfied the contractor is registered and not prohibited from tendering (reg 25(9)).
  • The grade a tender needs comes from its estimated value and the grade table (regs 17 and 25(3)), reference data this library does not hold.

Before the tender

A contractor tenders on the strength of a valid cidb registration; after award, the employer has its own duties.

What this page is, and is not

It is the section text this library holds for South Africa's Construction Industry Development Board Act, 2000 (Act 38 of 2000), Construction Industry Development Regulations, 2004, Construction Regulations, 2014, General Administrative Regulations, 2003 and Occupational Health and Safety Act, 1993 (Act 85 of 1993), with the window and the consequence. It is not legal advice, and it is not a substitute for reading the Acts, the Regulations and the contract you signed.

Demiton does not yet track South African projects. These pages set out the duties; the product does not run these checks on a South African job today.

No library of law is complete, and Demiton never says this one is. An obligation the library does not hold, and you did not add, is not protected. You can add your own to any job.
