What do Ireland's Construction Regulations 2013 require on site?
The Safety, Health and Welfare at Work (Construction) Regulations 2013 set the safety roles on an Irish construction project. The client appoints a project supervisor for the design process (PSDP) and one for the construction stage (PSCS). The PSCS notifies the Health and Safety Authority, develops the safety and health plan and keeps the record of Safe Pass confirmations.
Who does what
- The client appoints the supervisors. Appoint in writing a competent project supervisor for the design process before design starts, and one for the construction stage before construction work starts, and get each appointee's written acceptance (reg 6(1)-(5), 7(1), 7(3), 24(2)).
- The PSCS notifies the HSA. Notify the Health and Safety Authority in writing, before construction work begins, with the particulars Schedule 3 lists, when the work will last more than 30 working days or exceed 500 person days, and display those particulars on site (reg 22(1), 22(2); Sch 3).
- The PSCS runs the plan. Develop the safety and health plan before construction work starts, keep it adjusted as the work progresses, and bring it and its rules to the attention of every contractor (reg 16; 24(1)(g)-(i)).
- Every contractor checks the cards. Make sure every construction worker under your direct control holds a valid Safe Pass card, and a construction skills card for any task Schedule 5 lists (reg 4(2)-(4), 25(1); Sch 4 para 2 (S.I. No. 129 of 2019 reg 4), Sch 5). Then, on each worker's first day on site, ask to see their registration card and give the project supervisor written confirmation that they hold it and the other certificates the law requires (reg 25(2), 17(5)).
